	農業轉基因生物進口安全管理辦法     2004-07-16修 第十一條    引進的農業轉基因生物在生產應用前，應取得農業轉基因生物安全証書，方可依照有關種子、種畜禽、水產苗種、農藥、獸藥、肥料和添加劑等法律、行政法規的規定辦理相應的審定、登記或者評價、審批手續。

中華人民共和國種子法    第八章 

第五十條 從事商品種子進出口業務的法人和其他組織，除具備種子經營許可證外，還應當依照有關對外貿易法律、行政法規的規定取得從事種子進出口貿易的許可。

從境外引進農作物、林木種子的審定許可權，農作物、林木種子的進出口審批辦法，引進轉基因植物品種的管理辦法，由國務院規定。

商業生產的法定需求

1. 取得農業轉基因生物安全証書。(條件是經過改良、可區別、穩定、一致與品種名稱)

2. 取得品種審定證書、生產許可證和經營許可證。(經經企業註冊所在地省級農業行政主管部門審查通過)
